  4. Video released Tuesday shows officers responding to a report of someone pointing a gun from a hotel window in Mesa, Arizona, but a judge barred the release of additional footage showing an officer later shooting and killing an unarmed man at the scene, the Associated Press reported.

The shaky bodycam footage was taken during a Jan. 18 call that ended with Officer Philip Brailsford fatally shooting Daniel Shaver of Granbury, Texas, the AP reported.

Brailsford has pleaded not guilty to a charge of second-degree murder in Shaver’s death, the outlet said.

    Brailsford (Image source: KNXV-TV)

Former Officer Philip Brailsford (Image source: KNXV-TV)

Maricopa County Superior Court Judge Sam Myers ordered portions of the video released after Shaver’s widow and news organizations, including the AP, called for its unsealing to hold police accountable and serve the public interest, the AP noted.

But the order bars the public release of the face-to-face encounter between officers and Shaver until Brailsford’s case is resolved, the outlet said.

    More from the AP:

Investigators said in police records and in court that the video shows Shaver on the ground outside his room as he is ordered to crawl toward officers and tearfully pleads with them not to kill him. Officers at the scene say they believed Shaver was reaching for a gun.

No weapons were recovered from Shaver’s body. Investigators found two pellet rifles in the hotel room that were later determined to be part of his pest-control job.

Brailsford was later fired for violations of departmental policies.

The video shows Brailsford and other officers getting into a hotel elevator, listening to a sergeant voice a plan for getting Shaver and a woman out of the room, and waiting for several minutes as their calls for the pair to come out went unanswered.

“Listen to my instructions or it’s going to become very uncomfortable for you,” one officer was heard shouting on video.

Brailsford’s edited bodycam video concludes when someone exits the room, and the second edited video concludes with a woman being escorted from the hotel. Shaver isn’t seen in either edited clip.

Both the state of Arizona and lawyers representing Brailsford had previously petitioned the court to keep bodycam video of the shooting sealed, KNXV-TV reported.

“There is no dispute [Brailsford] caused the death of the victim,” Judge Myers has said, the station reported. “The question is really his state of mind and whether or not there is any legal justification to his actions.”

Brailsford said he used his gun over fear that Shaver was reaching for a gun while laying on the floor, KNXV said.

On her GoFundMe page for Shaver, his widow Laney Sweet outlined what she said happened, but offered no source of the information:

Daniel had befriended two individuals, a man and woman, who were staying at his hotel and invited them to have some drinks in his room. The woman saw Daniel’s case and questioned if it was a musical instrument. He told them that it was for his pellet guns he used for work. Then the man and Daniel took turns holding it and looking out of the scope near the window of his hotel room.

Unknowingly to my husband, two guests in the hot tub saw into Daniel’s 5th floor window and stated they saw men with a gun near the window of a 5th floor hotel room and notified front desk workers who called police.

The man in the room stepped out to call his wife momentarily. While he was gone, officers arrived and ordered Daniel and the woman out into the hallway onto their hands and knees. Through a mix of demands, Daniel cried out “Please don’t shoot me” as he tried to keep up with the changing demands the officers shouted at him while on the ground with his legs crossed behind him. His right arm made a motion near the side of his body, as if he lost balance, and officer Brailsford shot him with an AR-15 five times. Daniel has gunshot wounds ranging from his face down to his knee. Daniel was unarmed and fully compliant. He died instantly in the hallway.

Here are the two edited bodycam clips:

  6. Graduating students at California State University, Fullerton turned on the keynote speaker at a ceremony honoring the school’s College of Communications over the weekend after she used her speech as an opportunity to attack presumptive Republican presidential nominee Donald Trump.

Maria Elena Salinas, an anchor for the Spanish language broadcast network Univision, addressed the university’s entire graduating class of 2016 Sunday morning. Noting that 40 percent of the university’s student body is Hispanic, she delivered part of her speech in Spanish.

Several students thanked Salinas afterward for addressing their parents in their native tongue, the Washington Post reported. The school even presented the anchor with an honorary doctorate.

When Salinas, 62, spoke to the university’s College of Communications in a separate ceremony later that day, she thought she had a pretty good read of her audience. She was wrong.

Denise De La Cruz, a graduating senior writing for the OC Weekly, recalled the event:

Salinas’ speech was well-received until it became a little too Latino-centric for some and blatantly anti-Trump. The Univision broadcaster began specifically congratulating Latino journalism graduates for what seemed like a large chunk of her speech. She then began speaking in Spanish. … This left non-journalism grads and non-Latinos/non-Spanish speakers feeling excluded. Parents in the audience and even students in the ceremony began demanding Salinas switch to a more inclusive tone by shouting phrases such as, “What about us?!”

Things got worse when Salinas began advising aspiring journalists to use certain media tactics to diminish political figures like Trump.

After Salinas’ mention of the presumptive GOP nominee, students began yelling at her to “Get off the stage!” and calling her “Trash!” according to the Post.

De La Cruz told the Post Tuesday that, while some of the people in the audience Sunday said they didn’t feel any tension from the crowd, others noted the hostile reactions to Salinas’ Trump comments. “I would say it was tense throughout the speech,” De La Cruz said. “I looked around and a lot of graduates were visibly upset — some were muttering criticisms.”

On Tuesday evening, a spokesman for the university told the Post in an email, “I did not attend the ceremony for our College of Communications, but I am aware that some in attendance had concerns about comments made by Maria Elena Salinas.”

Salinas told the Post, “It’s really sad. And it’s a testament to what has happened in our country. Our country is really divided.”

Salinas claimed that she could hear some people yelling during her brief address but couldn’t hear what they were saying. She learned later from a student that some were upset by her comments.

In video from the event, Salinas is heard saying, “They blame us so much for so many things, that now they’re even blaming us, the media, for creating Donald Trump. Imagine that.”

As shouting could be heard from the crowd, Salinas continued, “Isn’t that terrible? But we didn’t, right? Who did it? I don’t know.”

    The yelling continued.

“If you allow me to say a few words in Spanish,” she went on, but someone called out, “No!”

Since the speech, Salinas said she has received a lot of negative feedback on social media from students who found her speech exclusive and divisive. She told the Post that some people sent messages telling her to go back to Mexico, even though she was born and raised in California.

“It’s really sad that people can turn such a special moment into a racial war,” she said. “Because it seems like that is what has happened. I don’t think I insulted anyone by saying a few words in Spanish to the parents. The whole speech was directed to everyone. … I think the message is, we have to cool down the intolerance right now, we really do. This is ugly, what’s happening in the country.”

“What I have seen on Twitter is really going out of control,” Salinas added. “A lot of insults. That really does come from the presidential race. When you have people insulting you and #MakeAmericaGreatAgain, you have to wonder.”

  12. Two veterans clashed during a segment on “The Kelly File” on Tuesday night over the fact that Donald Trump ended up raising less money for veterans than he had previously stated.

Sgt. Robert Bartlett told host Megyn Kelly that he believes that it’s important for people who say that they are supporting veterans to act in accordance with that sentiment, saying that he is hopeful that Trump was doing the right thing back in January when he skipped a Fox News debate to raise funds for American servicemen and women.

“I just want politicians or people running for office to be honest and do the right thing. If you say you support the vets, then do so,” he said. “That’s what the American public is asking for. They’re asking for these politicians who are running to do the right thing.”

Watch the latest video at video.foxnews.com

But Navy SEAL Carl Higbie hit back, saying that he believes that Bartlett’s comments were “uncharacteristic of a veteran.”

“Sgt. Bartlett, with all due respect, I think that’s fairly shallow of you to say that Trump only gave $4.5 million dollars — sure, he said $6 million; it’s a million and a half dollars,” Higbie said. “I think that’s a ridiculous statement and I think it’s honestly uncharacteristic of a veteran to say something like that, respectfully.”

Bartlett, though, said that he wasn’t trying to specifically target Trump and that he was simply calling on people to make good on their word — and to own up to their mistakes if and when they unfold.

“I didn’t even say any of that,” he said. “What I did say is that people need to be held accountable for what they do say and what they do.”

Higbie said that he believes that Trump has done a great deal for veterans, and that critics are simply looking for something to pin on the presumptive Republican presidential nominee.

“Megyn, I think this is a little bit like a witch hunt,” he said. “This is like a high school kid complaining that he got a Lexus instead of a Lamborghini.”

  13. LONDON (TheBlaze/AP) — Anglo-Dutch oil company Royal Dutch Shell says it will trim at least 2,200 jobs globally amid challenging times in the oil industry.

The losses are in addition to cuts already being implemented because of the energy company’s merger with BG. The losses will include some 475 positions in the North Sea.

The number brings the total number of Shell job cuts so far in 2015 and 2016 to 12,500. The company said that it will cut at least 5,000 jobs in 2016 alone, Bloomberg News reported.

Oil companies around the world are slashing jobs and postponing investments to adjust to lower energy prices. Prices have fallen because production remains high even as slower economic growth, particularly in China, reduces consumption.

Paul Goodfellow, Shell’s vice president for the U.K. and Ireland, told staff on Wednesday that these are “tough times for our industry and we have to take further difficult decisions to ensure Shell remains competitive through the current, prolonged downturn.”

“These are tough times for our industry,” Goodfellow said, according to Bloomberg News. “We have to take further difficult decisions to ensure Shell remains competitive through the current prolonged downturn.”

  14. DODGE CITY, Kan. (TheBlaze/AP) — Crews are evaluating the damage Wednesday after tornadoes destroyed several homes and left two people critically injured in western Kansas as a series of severe storms swept across the Plains.

A photo posted by Zach Wienhoff (@z_wienhoff) on

Meanwhile, one person drowned in central Oklahoma after a vehicle was swept off a road and a 13-year-old boy was found safe in northeastern Arkansas three hours after falling into a flooded drainage pipe.

The most damage in Kansas was reported in Ford and Hodgeman counties, where a storm dropped multiple tornadoes during a two-hour span Tuesday night, said meteorologist Andrew White of the National Weather Service office in Dodge City. He said less damaging tornadoes were reported in two other Kansas counties.

Watch some of the stunning video captured:

Emergency management officials in Ford County reported that two people were critically injured Tuesday night and taken to a hospital in Dodge City, the Kansas Adjutant General’s Department said in a statement early Wednesday.

    No fatalities were reported.

Preliminary reports indicate that at least one of the Kansas tornadoes was a half-mile wide. White said crews were working to determine how many tornadoes touched down, their strength and how long they were on the ground.

Besides damaged homes, White says U.S. 50 was temporarily closed because a tractor-trailer was toppled in the storm. He said a large propane tank tipped over and leaked near Dodge City, where 3-inch hail also was reported.

In Oklahoma, the drowning happened early Wednesday when a vehicle was swept into a drainage culvert near the small town of Davenport, about 50 miles northeast of Oklahoma City, the highway patrol said. The National Weather Service said 3 to 6 inches of rain fell in parts of Oklahoma, and that a flood warning was in effect through Wednesday afternoon.

In Arkansas, the boy who fell into a storm drain wasn’t seriously hurt. Police Cpl. Jason Chester tells television station KAIT that the boy said he clung to a pole. He was rescued after two officers heard his cries for help and pulled him to safety.

Elsewhere, several structures were damaged when a “probable” tornado touched down in northeast Oklahoma, near Bristow, according to the weather service. The Oklahoma Highway Patrol said no one was injured.

In Michigan’s Upper Peninsula, two weak tornadoes snapped pine trees, the National Weather Service said. No injuries were reported. The agency said the first tornado was detected near Republic, Michigan, on Tuesday afternoon and the second a short time later nearby.

Tornado warnings were issued in parts of eastern Colorado and the Texas Panhandle, and the Storm Prediction Center in Norman, Oklahoma, said storms can be expected throughout the week in the Great Plains.

  18. Senate Democrats are debating replacing Democratic National Committee Chairwoman Debbie Wasserman Schultz prior to the national convention, according to CNN. The debate stems from allegations that she has become “too toxic” to continue serve as the leader of the party in the midst of a “civil war” in the party.

The Florida congresswoman has faced severe criticism during the Democratic presidential campaign for her actions as party chair — most notably from supporters of Vermont Sen. Bernie Sanders, who argue that she favors former Secretary of State Hillary Clinton and has rigged the primary process. Sanders himself has been a vocal critic of Wasserman Schultz — even going so far at to endorse her primary opponent and vowing that as president he would not reappoint her as party chair.

A “pro-Clinton Democratic senator” told The Hill Tuesday, “There have been a lot of meetings over the past 48 hours about what color plate do we deliver Debbie Wasserman Schultz’s head on.”

“I don’t see how she can continue to the election. How can she open the convention? Sanders supporters would go nuts,” the senator added.

An anonymous “senior Senate Democratic source” echoed the sentiment to CNN.

“There is a lot of sentiment that replacing her would be a good idea,” the source told CNN. “It is being discussed quietly among Democratic senators on the floor, in the cloakroom and in lunches.”

Another senior Senate Democratic aide told CNN that replacing Wasserman Schultz “is something the caucus has discussed.”

Wasserman Schultz still has the support of some leading Democrats in Congress, including House Minority Leader Nancy Pelosi (Calif.).

“DNC Chairwoman Wasserman Schultz enjoys the support of members of the House Democratic Caucus for her leadership in unifying the party and winning in November,” Pelosi told CNN.
