MEXICO CITY - The Supreme Court of Justice of the Nation (SCJN) analyzes the case of the mother of a Rarámuri girl suffering from leukemia, who opposes having her daughter receive blood transfusions because her religion (Jehovah's Witnesses) prohibits because of a biblical interpretation that "God has commanded Christians to abstain from blood."

In order to prevent doctors and authorities from insisting on transfusion, the woman, whose name remains anonymous, filed an amparo (legal remedy that proceeds in case of human rights violations) against the Comprehensive Family System (DIF) of Chihuahua, the institution of the government that took custody of the child to follow the medical recommendations.

Through her lawyers, she argued that the Assistant Attorney General for Child and Adolescent Protection "discriminated" her for not accepting her proposal to use "alternative means" for transfusion, although she did not clarify what those means would be.

Judge Mauricio Fernández Mora granted the amparo and ordered that all "alternative means" be applied first before the transfusion and asked the three powers of Chihuahua - executive, legislative and judicial - to carry out reforms and create a protocol for doctors to be heard by the courts when a parent refuses to administer treatments to children.

Conformed by this resolution, the Chihuahua authorities took the case to the SCJN where it is discussed in the last hours and against time because the girl, who already received chemo, is not receiving any transfusion and her life is in danger.

The Network for Children's Rights in Mexico, one of the organizations with the greatest impact on public policies in favor of children, reminded Supreme Court justices that "there are already international instruments" and "national laws" that they consider to children as citizens with full rights, among which, the most important is the right to life.

"In Mexico we have a cultural problem of considering children as parents' property and it is not," said Juan Martín Pérez, president of the Network.

The activist questioned the fact that, in the case of the Rarámuri girl, the parents' faith is extended to their children because not even the law of customs and customs of the native peoples forbids transfusions.

"The supreme court is going to have to listen with the help of the professionals also to the girl and to obtain the position in the subject. I believe that at the heart of the debate and the legal challenge is to make it clear that children are the property of parents. Or not".
